CERC Matter Update – ACC approval still awaited as per MoP. SC not happy with the progress thus far. CERC argued that orders reserved must be pronounced. Petitioner contends that the orders that were reserved were illegal and all matters need to be reheard. As the Judgment does not give any leeway to a hearing without judicial member. SC held:
1. Govt has no intent in appointing Legal Member as per Order dates 28.08.2020.
2. 26.10.2020 SC called for record of CERC to ascertain the pendency.
3. CERC has filed an affidavit of 177 orders being reserved. SC not happy with orders from Feb March not being pronounced. Also records 100 plus Tariff order is pending.
4. However, govt is taking too long and is not concerned with the plight of consumer and commission.
5. Therefore, SC not inclined to permit pronouncement of reserved orders.
6. SC anguished with the way Govt acted contrary to the Judgment SC.
7. Passage of time has not awoken the govt to the problem at hand as 4 months has passed. SC cannot come to the aid of the consumer when Govt itself is not interested.
8. Matter now kept on 20.01.2020 as the matter is pending consideration before ACC
