Learned counsel for the petitioner submits that the issue involved in this case has been answered by the Supreme Court in a recent decision passed in case of Uttar Pradesh Power Transmission Corporation Ltd. Vs. C.G. Power and Industrial Solutions Ltd reported in 2021 SCC OnLine SC
383. He further submits that in an identical matter i.e. W.P. No.8730/2021, the coordinate Bench has issued notices to the respondents and also granted interim protection.
Considering the aforesaid, let notices be issued to the respondents on payment of process fee within a period of seven days by registered mode.
By way of interim measure, it is directed that till the next date of hearing no coercive action shall be taken against the petitioner.
Notice be made returnable within four weeks. List this matter along with W.P. No.8730/2021.
